West Virginia State Board Of Education V. Barnette
(319 U.S. 624 1943)
   In West Virginia State Board of Education v. Barnette on June 14, 1943, the Supreme Court ruled by 8-1 in favor of the Jehovah’s Witnesses and against a state law making saluting the flag and pledging allegiance a requirement in schools. In doing so, they overturned their earlier 1940 decision in Minersville School District v. Gobitis. The author of the earlier decision, Justice Felix Frankfurter, wrote an angry dissenting opinion to the 1943 decision.
