Becoming law on 25 June 1938, the Fair Labor Standards Act was one of the major reform measures of Franklin D. Roosevelt’s New Deal. Minimum wage provision had originally been included in the National Industrial Recovery Act of 1933, but when the act was declared unconstitutional by the Supreme Court, it was clear that further measures were necessary. The Fair Labor Standards Act set a minimum wage of 25 cents per hour in 1938, increased to 30 cents in 1939, and a maximum working week of 44 hours, reduced to 40 by 1940, for all workers engaged in interstate commerce. Agricultural workers, domestic servants, seamen, fishermen, and street rail workers were excluded.
